REGULATIONS OF USING ALTERSKLEP TO PURCHASE ELECTRONIC TICKETS

  • §1. Definitions:

    The terms below written with a capital letter will have the following meaning in these Regulations:
    Organizer - means Alter Art Festival Spó³ka z o.o. company with the seat in Warsaw, ul. Kazimierzowska 14, entered in the register of companies of the National Court Register by Warsaw District Court under KRS number 227624, with seed capital of 50000 PLN paid in full and NIP number 586-214-15-57.
    Price - means the price of Electronic Ticket given in the Service. Prices are given in Polish zloty and include VAT (they are gross prices).
    Customer - means a natural person, a legal person or an organizational unit without legal entity, with legal capacity, that is the user of the Service.
    Service - means internet service: www.alterart.pl/shop/shop.php where Customer is entitled to purchase Electronic Ticket, besides the chain of Points of Sale.
    Order number - means the unique number given by Service while ordering Electronic Ticket.
    Electronic Ticket - means the ticket generated in the computer system of Service, entitling its owner to enter Event after completing and printing out the ticket and after he/she has fulfilled the conditions of these Regulations and the regulations of individual Events. Electronic Ticket is not delivered to Customer by Organizer. Customer prints Electronic Ticket in Service by himself/herself.
    Event - means an entertainment service, also open-air events, including concerts, festivals, music events or dance and music events, etc.
    Points of Sale - means the outlets in which any Customer may purchase tickets for Events in a form of traditional document paying at receipt: by cash, credit card or debit card. Points of Sale are managed by TICKETPRO and EVENTIM companies and they have no connection with Service. The list of Points of Sale may be found on www.ticketpro.pl and www.eventim.pl.
    Act - means the March 2nd 2000 Act about the protection of some consumer rights and liability for damage caused by dangerous substances (DZ.U.2000 nr 22 pos.271 with later changes).

  • §2. General rules:

    Service is intended for persons, consumers and entrepreneurs, who want to purchase Electronic Tickets for Events organized by Organizer via internet. Persons who want to purchase a ticket for Event in the form of traditional document, payable at receipt: with cash, debit card or credit card, should go to the nearest Points of Sale.

  • §3. Electronic Ticket Purchase:

    1. The condition of purchasing Electronic Ticket is the correct registration in Service which means full and correct completion of personal questionnaire and acceptance of these Regulations. The completion of the registration procedure entitles the user to purchase Electronic Ticket. Registration procedure is completed only once. At registration Customer is given a login and a password which are confidential. Customer takes the responsibility for damages caused by revealing them to other persons by Customer. Customers using the login and the password may update their data given at registration. Customer is responsible for not updating the data. Subsequent purchases may be made in Service with the use of login and password.
    2. In order to purchase Electronic Ticket Customer chooses the form of payment by clicking "[pay with money transfer]" or "[pay with credit card]" icons in Service. Credit card payment is made with the use of eCard system.
    3. When choosing "[pay with credit card]" form of payment, Customer should complete the personal questionnaire spaces specifying Customer's credit card data (such as: type of card, card number, expiry date). After [continue] button is pressed, the credit card is authorized and charged with the amount due for the purchase.
      Caution! Giving wrong credit card data will result in rejecting the query by the system. By completing the reservation Customer consents that his/her credit card be charged by the system.
      Caution! We wish to inform that the system has no influence over the moment of charging the card's owner's account. We also inform that the use of other people's credit cards as a form of payment is a crime against property and is punishable by imprisonment under the Art. 278 par. 1 Kodeksu Karnego (of Penal Code).
    4. In case the accounting currency of the credit card is not Polish currency, the amount charged might differ slightly from the price of the purchased product, due to converting of the currencies and exchange rate differences, in accordance with the regulations applied by the payer's bank.
    5. Payments by transfer should be made to the account:

      account number: 23 1750 0009 0000 0000 1090 0638.
      On the transfer order, the title of payment should be described in the following way: "order number, first name and surname of Customer".
      Caution! In case of payments by transfer into Organizer's account, the payment should be made within 2 working days from the moment of placing the order. Missing this deadline results in canceling the order. It does not exclude the possibility to place another order in accordance with general rules.
  • §4. Electronic Ticket Printout:

    1. Customer may print Electronic Ticket after 3 working days from entering the amount in the bank account for payments by bank transfer or from the day of payment by credit card. Electronic ticket will appear after logging in on Service website in "my tickets" section. Before printing Electronic Ticket, Customer is obliged to complete the ticket with his/her personal data: first name, surname. Having completed the tasks mentioned above Customer can print out Electronic Ticket. Printing out is possible until the day before the day of starting Event. After entering and confirming the owner's data Electronic Ticket cannot be given to another person.
    2. The admission to Event will be possible after presenting Electronic ticket printed out in Service and the identification document at the entrance to Event.
    3. In case Electronic Ticket represents more than one entrance ticket to Event, all interested persons are obliged to enter Event together with the owner of Electronic Ticket.
      Caution! The bar code located on Electronic Ticket must be printed correctly and in full. In case of incorrect printout, it should be repeated. In case of the next unsuccessful attempts, the irregularities in printed bar code should be reported to shop@alterart.pl
  • §5. Detailed provisions concerning Electronic Ticket:

    1. Organizer informs that in accordance with art. 16 sec. 2 of the Act Customer is not entitled to withdraw from the agreement under art. 7 of this Act.
    2. In case of Events organized in the open air, if Organizer cannot accomplish the service due to unfavorable weather conditions or due to failure to obtain/withdrawal of permits necessary to carry out Event, Organizer reserves the exemption from the obligation to inform about the inability to accomplish the service in the manner described in art.12 sec. 2 of the Act.
  • §6. Personal data protection:

    1. Customer while registering in Service agrees to have their personal data given in the questionnaire collected and processed by Organizer as defined by the 29th August 1997 Data Protection Act (Dz. U. (Law Journal) 2002 nr 101, part 926 with changes) exclusively to complete the orders in Service.
    2. Customer can consent to receive promotional and trade information, also via electronic means of communication from Organizer. Such consent is not the condition necessary to complete the order. The consent is given by Customer by marking the appropriate option in the application form.
    3. Customer has the right to access the personal data given and to correct it, and also to demand that the data be removed.
  • §7. Customers' rights and obligations:

    1. Customer is obliged to:
      a) use Service according to law regulations, the provisions of these Regulations and decency,
      b) give true personal data and payment information,
      c) not to use Service to make false reservations or any other forbidden acts.
    2. Organizer has the right to refuse the sale of Electronic Ticket in case Customer breaches the provisions of Regulations.
    3. Organizer warns that appropriate law enforcement bodies will be informed about acts having features of an offence by the Act (hacking, fraud), which does not exclude the civil suit for damages.
  • §8. Final Provisions:

    1. Customer has the right to make a complaint to Organizer's address:

      In order to make the complaint procedure easier, it is advisable to add a note "Complaint". The note is not a necessary condition for the complaint to be investigated.
      Complaints can be made without delay after recognizing the circumstances justifying the complaint. Customer should give Organizer all information and documents concerning the complaint which may be helpful in its investigation. Organizer should complete the investigation of the complaint without delay, no later than within 14 days.
    2. The regulations of individual Events as well as additional regulations of purchasing tickets for individual Events are available in Service and on Organizer's website and may contain additional relevant information or procedural differences. In case of discrepancies between above mentioned documents, the regulation of Event and regulations of purchasing tickets for individual Events take precedence.
    3. These Regulations are available on transaction pages of Service.
    4. Organizer has the right to change Regulations. The changes in Regulations will be announced on transaction pages of Service.
